Terms of Service and Waiver

By using this website and any affiliated online resources as well as by attending any activity associated with or operated by Roaring Fork Fencers Club LLC DBA Aspen Fencing Camp (hereafter “The Camp”), you agree to the following Terms of Service.

Rights Reserved

The Camp reserves all rights to all intellectual property, physical property, media (electronic and physical), and all other material and property, tangible and intangible, resulting from the operation of Aspen Fencing Camp before, during, and after any given event and at any other time. The Camp requests that any use of any material relating to Aspen Fencing Camp be requested in writing before the use thereof.

Limitation of Liability

Camp attendees, prospective and those who physically attend the event, are notified that fencing is a physical sport and entails all the risks involved with physical activity. Furthermore, Aspen Fencing Camp is taking place at high elevation and during cold months and attendees should consider themselves notified of the complications of both and urged to make all necessary investigation and preparation with regards to these unique conditions. The Camp will follow all reasonable safety protocols associated with sport in general and fencing specifically but cannot guarantee the physical health and safety of any given participant.

Furthermore, Roaring Fork Fencers Club LLC is a current member club of USA Fencing with valid insurance through USA Fencing. All attendees must have an active membership with USA Fencing that ensures insurance coverage compliance. The Camp and attendees agree to abide by the liability clauses established as part of membership with USA Fencing.

The Camp cannot be held liable for complications arising from any medical condition not previously disclosed by an attendee.

Governing Law and Jurisdiction

All parties accept the State of Colorado for jurisdiction in all legal matters. This is in accordance with the membership agreement with USA Fencing and as a fact of The Camp transpiring within the State of Colorado.

Child Protection

The Camp will stringently follow all policies set forth in the most recent Minor Athlete Abuse Prevention Policies (MAAPP) published by the US Center for SafeSport and USA Fencing. All staff members will be SafeSport compliant and all interactions between minors and adults that are not SafeSport certified will follow procedures to ensure compliance with the MAAPP.

Lost Property

The Camp will hold any lost property for a period of 30 days. Upon verification of ownership, The Camp will return the lost property at the sole expense of the individual that left it behind within 30 days after verification of ownership and agreement upon shipping conditions and costs or other methods of return.

Privacy Policy

The Camp will collect email addresses, phone numbers, and home addresses of attendees as a necessity of operations. The Camp reserves the right to use that information for future marketing until the attendee opts out via written notice.

The Camp will notify attendees of any distribution of personal information and allow for an opt-out before rendering the data to third parties.

Payment and Refunds

The first 15 registrations will be charged a 25% deposit instead of the full price of the camp. Upon deposits for 15 full price registrations being received by The Camp, the remainder of the camp fee will be charged to parties with deposits via the payment method on file or other prearranged payment method. At that point, all fees are due in full at the time of registration for all future enrollments.

If 15 deposits for full price registrations have not been received by November 1, 2024, The Camp may exercise sole discretion to elect to refund those deposits or otherwise reach a compromise with any deposited or otherwise interested parties to modify the camp to accommodate smaller attendance numbers.

All registrations are eligible for refund within 48 hours via written notice to The Camp. After 48 hours, registration fees are non-refundable.

The Camp reserves the final right to offer a refund outside of 48 hours in extraordinary circumstances. Reasons of health, travel difficulties, or any other cause by an attendee to seek a refund will be denied except at the sole discretion of The Camp. Attendees concerned about the need for a refund are advised to consider travel insurance through a third party.

All refunds are subject to a 5% processing fee, including any refunds of deposits.

Registrations after November 1, 2024 are subject to a $100 late fee.

Grant Program

The Camp is operating a grant program at its sole discretion to assist fencers in attending various Camp-related events. Grants are applied for by prospective attendees via a written application and are reviewed by The Camp. At its sole discretion, the Camp may elect to award a grant to the applicant which will be applied to their registration fees. The applicant will be responsible for paying the difference between the initial price of the event and the grant amount. The amount granted to each applicant, if any amount is granted at all, is at the sole discretion of The Camp. The Camp is not obligated to reveal the grant review or award process in any way as the entire grant program is operated at the sole discretion of The Camp.

Code of Conduct

The Camp expects all attendees to participate in a cordial and collegial manner. Any action that breaks the SafeSport Code is grounds for dismissal without refund. Any discrimination or harassment on the basis of race, gender identity, sexual orientation, socioeconomic status, neurodiversity, physical ability, or any other intrinsically defining trait is grounds of dismissal without refund. Any attendee that willingly endangers another attendee may be dismissed without refund.

The Camp and its staff reserve the final right to temporarily or permanently remove any attendee deemed to be disruptive to the camp or to be negatively impacting camp operations and potentially dismiss them without refund.

Communication Policy

The Camp will strive to keep all registrants informed of all pertinent plans, developments, and changes via written communication through the camp website, email, or text message. Registrants are advised to thoroughly review the camp website in order to be well informed about planned camp operations. Registrants are also advised to monitor the email under which they register for any updates.

The Camp will not directly communicate with minor participants except when including a parent or guardian on these communications.

Facilities Policy

Aspen Fencing Camp is being held at Aspen High School. Any vandalism or property damage caused through recklessness will be considered the financial burden of the attendee which incurred said damage. Attendees must use the facilities in accordance with the US Center for SafeSport MAAPP.

Safety Measures and Emergency Procedures

The Camp will strive to have a professional on hand to assist with medical concerns that arise during the course of camp operations, but cannot guarantee said presence. Aspen Valley Hospital is a 1.5 mile or approximately 5 minute drive from Aspen High School and will be the treatment center for serious injuries or conditions requiring immediate medical attention.

For non-emergency medial concerns, The Camp and its staff will use their best judgement for the welfare of the injured party regarding treatment and if the injured party needs to be transported to a medical facility off site.

In the case of a non-injury-related emergency, such as weather or damage to the facility, The Camp and its staff will use their best judgement to attempt to ensure the safety of attendees.

Media Release

By attending Aspen Fencing Camp, attendees agree to a media release of their likeness for any and all business-related uses by The Camp unless the attendee opts out in writing, either for specific or all uses. Minors attending the camp are assumed to have their likeness released for media use by the adult whom registered said minor unless said adult opts out of the release of media in writing.

Severability

These Terms of Service are considered dissociable so that if a section, clause, or term is found to be illegal or unenforceable, the remainder of these Terms of Service still applies.

Modifications to the Terms of Service

Any modification to the Terms of Service that substantially alters the agreement between The Camp and a registrant or attendee will be communicated to said registrant or attendee in writing with the registrant or attendee having a period of 15 days upon receiving said notice to dispute the change and come to a modified Terms of Service agreed upon in writing and signed by both The Camp and the registrant or attendee. The Camp reserves the right to cancel the registration of a registrant or attendee if a mutually agreeable modified Terms of Service cannot be agreed upon.

Any party not registered to a specific event with The Camp does not have the right to dispute and/or request to modify the Terms of Service.
